Apple comes under the CCI scanner in India when a customer filed a complaint against Apple under The Competition Act 2002 (amended in 2007) stating that Apple is restricting customers from buying apple products (iPhone) by making its availability for only a selected few carriers (Airtel and Aircel). The section 4 specifically deals with Abuse of dominant position.
Apple had announced the iPhone 4 for Airtel and Aircel customers last month, while the iPad is sold through Apple store only.
The complainant has also alleged that a user can only download software from the i-store and the others are not recognised by the device,a senior CCI official said.
The complaint also stated that the phone could be serviced in Apple centers only, which charge high rates for servicing. The Commission will look into the matter for consideration by the end of this week, sources said.
There are a few things the CCI must consider –
First of all, Airtel and Aircel are selling “unlocked” iPhones with optional offer i.e. you’re free to use it with any service provider you choose. Second, Apple products are sold not just by Apple Stores, but by various distributors – Croma, Imagine Stores and several others.
Finally, every manufacturer voids the products warranty if the device is serviced at unauthorized centers. Apple has 3rd party centers in India which operate with Apple to help with major issues.
Well, laws can get tricky. It all depends on the interpretation of the law. Apple will sure argue and explain how they operate in India, however they will definitely have a tough time fighting the case.

The Huawei Ideos first came into the limelight when it was unveiled at IFA 2010 in Berlin. It was showcased as the cheapest Android smartphone to date. It was to be priced at $150 for the unlocked version in the US, close to Rs 7000.
Since then, even cheaper Android smartphones have been launched, like the Micromax Andro A60, but the Huawei Ideos still holds the distinction for being the first truly budget Android phone. Today, Aircel announced that it will be launching the Huawei Ideos in India for Rs. 8499.
The Huawei Ideos is powered by Android 2.2 Froyo and comes with a 2.8 inch TFT capacitive touchscreen display with a resolution of 240 x 320 pixels. It has a 528 MHz processor with 256 MB RAM, 200 MB internal storage and up to 32 GB microSD card support.
It also has a 3.15 MP camera and GPRS, EDGE, 3G HSDPA, Bluetooth 2.1 with A2DP, Wi-Fi 802.11 b/g/n and GPS. It is powered by a 1200 mAh Li-ion battery. It’s one of the best Android smartphones in that price range, and probably the only budget Android phone to run Android 2.2 Froyo, unlike the Micromax Andro A60, which runs Android 2.1 Eclair.

Last year, Tata Docomo and Reliance launched their 3G services in India. This month, Airtel is expected to join the bandwagon. And now, Aircel announced that, the company will launch their 3G services in the next 40 to 60 days. It means that, the Aircel customers can enjoy 3G services on their 3G enabled smartphones from late February or early March.
We are planning to launch our 3G Mobile and Data services across 13 telecom circles where we have got the licences and 3G spectrum in another 40 to 60 days. Moreover, Aircel will be one of the first telecom operator in the country to usher into the fourth generation era. We are planning to start 4G /Broadband Wirelss Access (BWA) trials by the first or second quarter of the next financial year i.e. April 2011. The BWA-4G Services will be rolled out by December 2011 or January 2012 in 8 telecom circles,” said Mallikarjuna Rao, CTO, Aircel Ltd.

Tata Docomo will launch its 3G services in few days, but Aircel went a step further and became the first telecom operator to launch 3G experience zone in Chennai.
